As you can read in “How Killers Die”, Hannah Dowling’s murderer had no chance to negotiate terms that would enable him to live, being tried, sentenced and executed within a few days. What a contrast to a recent case in Mississippi, where 21-year-old accused killer Ira Kincaid came up for trail.
He and his counsel sought to alleviate the possible outcome – death in the gas chamber. As a result, Kincaid signed a unique contract to spend the rest of his natural life in the state penitentiary, in return for a promise from the district attorney not to seek the death penalty for the robbery-murder (a capital offence) of a shopkeeper. Kincaid then formally pleaded guilty and drew a life term for non-capital murder, plus 40 years for the armed robbery.
The contract he signed read, in part: !I shall not apply for, or accept, any parole, pardon, suspension, reprieve, or any other procedure resulting in anything but my confinement in state pneal authority custody for the remainder of my natural life.” Commended Prosecutor Craft: “Whithout that contract, Kincaid could have been eligible for parole in seven years.”
